DOE Issues Preliminary Determination on 2012 IECC

On October 19, 2011, DOE issued a preliminary determination in the Federal Register that the buildings meeting the 2012 IECC will achieve greater energy efficiency that those built under the previous 2009 edition. As required by federal law under the Energy Policy Act of 1992 (EPAct), after DOE issues a final determination, each state and territory (including the District of Columbia) is expected to certify that it has reviewed the provisions of its residential building code regarding energy efficiency and determined whether it is appropriate to revise the code to meet or exceed the 2012 IECC. If a state determines that it is not appropriate to revise its residential code to meet or exceed the 2012 IECC, the state is required to explain why in writing to the Secretary of Energy. Certification statements by the states are due within two years of publication of the final determination.

DOE also issued a final determination on ASHRAE 90.1-2010 on October 18, 2011.
